USTA National Campus Pro Shop Corn Hole Challenge Official Rules (the "Official Rules")

The object of the USTA National Campus Pro Shop Corn Hole Challenge (“Contest”) is to accumulate the most points as a team playing corn hole to win prizes from the USTA National Campus Pro Shop (“Pro Shop”).

CONTEST PERIOD. The Contest entry period begins on Friday, November 8, 2019 at 09:00 AM Eastern Time (“ET”) and ends on Friday, November 8, 2019 at 4:00 PM ET (the “Entry Period”).

ELIGIBILITY. The Contest is open only to legal residents of the United States (including the District of Columbia and other locales under United States jurisdiction, including Puerto Rico, Guam, American Samoa, American Virgin Islands, and other protected territories), who are 18 years of aocge or older. Do not enter this Contest if you are not a legal resident of and located in the United States (including the District of Columbia and other locales under United States jurisdiction, including Puerto Rico, Guam, American Samoa, American Virgin Islands, and other protected territories) at the time of entry. Void outside the United States and where prohibited by law. Employees of the United States Tennis Association Incorporated (“USTA”), employees of the USTA Sectional Associations, employees of Fromuth Tennis (“Fromuth”), and each of their respective subsidiaries, affiliates, parent companies, sales representatives, agents, advertising and promotion agencies or any other agencies or entities involved with this Contest and members of their respective families (parents, siblings, children, and spouse and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win. By participating in this Contest, participants agree to be bound by these Official Rules. The USTA and Fromuth reserve the right to disqualify from this Contest any person it believes has intentionally violated these Rules.

HOW TO PLAY. To play, each team participant will have the opportunity to throw up to six (6) beanbags during the Contest Period, with each team getting a maximum of sixty (60) throws. If a participating team has less than ten (10) members, the team captain can designate a member (or members) who will receive additional throws to bring the team total to sixty (60) throws. Participants will be required to stand behind the designated line and attempt to throw their beanbag onto the corn hole board. Participants will receive 3 points for a bean bag landing in the hole, and 1 point for a beanbag that comes to rest on the board. Points will be tallied by team and posted on Saturday, November 9, 2019 at the Pro Shop. The team with the highest total number of points will win the prize. In the event of a tie between teams, the team captains of each team will designate one participant who will participate in a “sudden death throw off” and receive three (3) additional throws. The score(s) from the additional throws will be added to the team score until a winner is chosen. Compliance with the foregoing requirements shall be determined by USTA and Fromuth in their sole discretion and USTA or Fromuth may, in their sole discretion, disqualify any participant.

By participating in the Contest, participants indicate their agreement with these Official Rules.

USTA and Fromuth may, in their sole discretion, extend the Contest Period or elect not to determine a winner of the Contest.

GRAND PRIZE: The winning team will be awarded a grand prize pack consisting of one (1) HEAD Racket String, one (1) HEAD Racket Grip, one (1) US Open Hat, and one (1) USTA T-Shirt for each member of the team (Approximate retail value (“ARV”): $400).

Each participant in the Contest will receive a discount coupon to the Pro Shop, which can be used on-line only.

The Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use are the sole responsibility of the Winner. All prize details shall be determined in the sole and absolute discretion of the USTA and Fromuth. Limit one (1) Prize per person, family or household.

CONTEST ADMINISTRATION. USTA and Fromuth will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by Fromuth regarding the Contest shall be final and binding in all respects.

CONSENT, LICENSE, AND RELEASE. By entering the Contest, each participant releases in perpetuity the USTA and Fromuth from any claims, demands, losses and liabilities of any nature arising out of or in any way connected with the Contest and the use thereof as permitted hereunder, including, but not limited to, claims of false endorsement or infringement of rights of publicity or privacy. Each Winner, by acceptance of Prize, grants to Fromuth, USTA, and their respective designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice, statements and/or other likeness, and prize information, in whole or in part, for advertising, promotional, trade and/or any other purpose in conjunction with this Contest and similar promotions in any and all media or format now known or hereafter developed, throughout the world, in perpetuity, without further compensation, consideration, notice or permission, except where prohibited by law.

TERMS AND CONDITIONS. The potential winners may be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release (where permissible) within 7 days of notification. In the event of non-compliance with any of these requirements, prize may be forfeited. By accepting the prize, the winner agrees to accept the prize in the manner set forth by Fromuth. The winner is responsible for all applicable federal, state, and local taxes on prize. No compensation will be paid in lieu of the prize. The USTA and Fromuth reserve the right to substitute a prize of equal or greater value if advertised prize is unavailable. Prize is not transferable, assignable or redeemable for cash. By participating, entrants agree to be bound by these Official Rules and by the decisions of USTA and Fromuth, which shall be final and binding in all respects. By accepting prize, winner releases and holds harmless the United States Tennis Association Incorporated, Fromuth Tennis, and their respective parent companies, subsidiaries, affiliates, dealers, and the directors, officers, employees or agents of any of the above organizations (the “Releasees”) from any and all liability and Releasees will be held harmless by winner and his/her heirs and executors for any injury including personal injury, death, loss or damages of any kind, arising from the negligence of Releasees or participation in or in connection with acceptance, possession, use, misuse and/or non-use of any prize or participation and/or traveling to any prize-related activities, or any claims based on right of publicity/right of privacy. The Releasees do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. The Releasees accept no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority. The USTA reserves the right to modify this Contest in any way it deems necessary or appropriate. Except where prohibited, by accepting prize, the winner grants USTA and Fromuth the right to use and publish his/her photograph, likeness, name, city, and state of residence and/or likeness for advertising and promotional purposes in any media in connection with the Contest without limitation and without additional compensation.

OTHER. The Contest is a skill contest designed to increase consumer awareness of and interest in the USTA National Campus Pro Shop. This Contest may not be used for, or in connection with, any form of gambling.

MISCELLANEOUS. Participants agree that this Contest is governed solely by the laws of the United States and any claims arising out of this Contest may be brought only in a federal or state court located in the counties of New York or Westchester, New York. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
